Terms, Privacy & Artwork Policy – GEMS OF INDIA 2026
This Terms, Privacy & Artwork Policy (“Policy”) governs participation in GEMS OF INDIA 2026, organised by Hina’s Art Pavilion (“HAP”). By registering for or submitting any entry to the competition, the parent or legal guardian of the child participant agrees to this Policy in full.
1. Eligibility and Participation
GEMS OF INDIA 2026 is open to children aged 1 to 17 years. Registration and all submissions must be made by a parent or legal guardian on behalf of the child participant. By submitting the form, you confirm that you are the lawful parent/guardian and that all information provided is true, complete, and accurate.
2. Registration Fee
A registration fee of ₹100 per artwork applies to each entry submitted. The fee is non-refundable under any circumstances, including withdrawal, disqualification, technical issues, incomplete submission, non-selection, or non-participation after registration.
3. Use of Personal Information
HAP may collect and process the personal information of the parent/guardian and child participant, including name, age, contact details, city, artwork details, and uploaded artwork images, for the purposes of:

- registration and participant verification

- communication regarding the competition

- judging, shortlisting, and result announcements

- administration, coordination, and event management
-
- awards, certificates, and related competition activities
Where the participant is a child, processing will be undertaken only after verifiable parental consent, as required under applicable law.
4. Accuracy of Information
The parent/guardian is solely responsible for ensuring that the information submitted is accurate and that the child is eligible to participate. HAP shall not be responsible for errors, omissions, or consequences arising from incorrect or incomplete information provided at the time of registration or submission.
5. Originality of Artwork
By submitting artwork, the parent/guardian confirms that the artwork is the original creation of the child participant and does not infringe the rights of any third party.
6. Artwork Usage Rights
By participating in GEMS OF INDIA 2026, the parent/guardian grants HAP a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, publish, display, exhibit, digitise, distribute, adapt, and communicate the submitted artwork and/or artwork images for purposes including, but not limited to:

- competition display and curation

- exhibitions and gallery showcases

- print and digital publicity
-
- social media promotion
-
- marketing and branding
-
- catalogues, publications, newsletters, press releases, and related material

- commercial or institutional use connected with HAP’s activities and initiatives
No additional approval, credit, or compensation shall be required for such use, unless otherwise agreed in writing by HAP.
7. Physical Artwork Submission
HAP may, at its discretion, request selected participants to submit original physical artworks for display, archiving, or collection purposes.
8. Non-Return of Physical Artwork
All physical artworks submitted to HAP shall be treated as final submissions and will not be returned to the participant. The artwork may be retained by HAP for exhibition, display, archival, collection, promotional, or related purposes. Participants should submit physical artworks only if they are comfortable with this condition.
9. Courier, Transit, and Handling Liability
Where physical artworks are submitted through courier or third-party transport, the participant/parent/guardian is solely responsible for safe packaging, dispatch, and choice of courier service. HAP shall not be liable for any loss, delay, breakage, damage, deterioration, misdelivery, or transit-related issue arising before the artwork is received by HAP. Once received, HAP will take reasonable care in handling and storage; however, HAP shall not be liable for damage caused by external transit or mishandling outside its control.
10. Judging and Results
All judging, shortlisting, selection, and award decisions made by HAP and/or its appointed panel shall be final and binding. HAP is under no obligation to provide individual feedback or disclose scoring details.
11. Certificates, Awards, and Recognition
Awards, certificates, medals, special jury recognition, workshop invitations, gallery opportunities, or related benefits are subject to the competition structure and selection criteria communicated by HAP from time to time.
12. Communication and Updates
HAP may contact the parent/guardian via phone, WhatsApp, SMS, or email for competition-related communication, including registration, payment, submission confirmation, judging updates, and results.
13. Future Promotional Communication
If the parent/guardian explicitly opts in, HAP may also send future updates regarding competitions, workshops, events, and other creative opportunities. Such communication will be sent only where separate consent has been provided.
14. Data Retention
HAP may retain participant and submission data for such period as is reasonably required for competition administration, record-keeping, legal compliance, archival, promotional, or institutional purposes.
15. Governing Law and Jurisdiction
This Policy shall be governed by the laws of India. Any dispute arising out of or in connection with this Policy or the competition shall be subject to the jurisdiction of the competent courts at the location of HAP’s registered office, unless otherwise required by law.
